Terms of Service

These Terms of Service ("Terms") govern access to and use of House Cleaner (the "Service"), a product of Tractus IA Sistemas Inteligentes Ltda, based in São Paulo, Brazil ("we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("Customer").
1. The Service
House Cleaner is a multi-tenant scheduling, operations, and communication platform for residential cleaning companies. We do not guarantee the availability of features not yet released.
2. Accounts and organizations
You are responsible for the accuracy of information you provide and for activity under your account. Each Customer organization is responsible for the conduct of its own members (owners, admins, supervisors, employees, contractors) and for granting them only the access appropriate to their role.
3. Subscriptions and billing
Paid subscriptions are sold and billed through the Tractus IA billing hub. Your subscription status (trial, active, past due, cancelled) is mirrored into the Service and may affect access as described at sign-up. Fees are non-refundable except as required by law or as we expressly state in writing.
4. Customer data
As between the parties, Customer retains all rights to the data it enters into the Service (customers, properties, jobs, messages, photos, and similar records). We process that data on Customer's behalf to provide the Service and as described in our Privacy Policy. Customer is responsible for having the necessary rights and consents to submit its own end-customers' personal information into the Service, including through the public booking pages.
5. Acceptable use
You agree not to misuse the Service — including attempting to access another organization's data, interfering with the Service's operation, or using it to violate applicable law.
6. Termination
Either party may stop using or providing the Service at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or as required by law. Sections that by their nature should survive termination (e.g. payment obligations, limitations of liability) will survive.
7. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind to the extent permitted by law. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Service, and our aggregate liability is limited to the amounts paid for the Service in the twelve months preceding the claim.
8. Governing law
These Terms are governed by the laws of the State of São Paulo, Brazil, without regard to conflict-of-law rules.
9. Changes
We may update these Terms from time to time. We will post the updated Terms here and update the "Last updated" date; continued use of the Service after changes take effect constitutes acceptance.
